A commission for William Marbury to serve as a justice of the peace had been issued by President John Adams in 1801, but James Madison, the incoming Secretary of State, refused to deliver it. Marbury filed a lawsuit to win it. Chief Justice John Marshall's ruling in Marbury v. Madison established the judicial review principle to prevent any one arm of the federal government from becoming overly strong.

For the first time, a statute approved by Congress and signed by the President was ruled illegal by the Supreme Court. Nothing in the Constitution expressly granted the Court this particular authority. Marshall, however, was of the opinion that the Supreme Court ought to play a role that is equivalent to that of the two other branches of the government.
