Exculpatory Clauses refers to the  part of a contract that prevents one party from holding the other party responsible for damages related to the contract.

   It is important to understand how and when exculpatory clauses are enforceable. The general rule is that exculpatory clauses are enforceable if they are reasonable. They are not valid if they are unconscionable or unreasonable. Additionally, they cannot excuse liability from harm which is caused intentionally or recklessly.

For instance, A skier who signs an agreement before skiing will agree to a clause that prevents the skiing business from any liability if the skier gets injured. But what if damages occur due to visible negligence from the skiing business?. This means that the exculpatory clause signed by the skier does not totally protect the skiing business.
