The Commerce Clause

The commerce clause as enshrined in the constitution of the United States gives the federal government power to regulate commerce.

 

The clause states that the "US Congress shall have power to regulate Commerce with other foreign Nations, and among the several States, and with the Indian Tribes"

The three main areas which this clause gives the federal government power to regulate are;

  • The power to regulate the channels of interstate commerce.
  • The power to regulate the instrumentalities of interstate commerce,
  • The power to regulate local activities that have a substantial economic effect on interstate commerce.
