The only option left to the tribes was to sign contracts with Albert Pike, a commissioner and military commander of the Confederate government.

At the Fort Smith Council in September 1865, talks between the federal government and the Five Tribes got under way. The American Indian delegation were informed by Commissioner of Indian Affairs Dennis N. Cooley that new treaties needed to be signed. It was clarified that when they joined the Confederacy, they renounced their rights, annuities, and property claims under the previous treaties. Elijah Sells, the Southern  Superintendent of Indian Affairs, and Ely S. Parker, a Seneca who would later serve as President Ulysses S. Grant's commissioner of Indian affairs, joined Cooley in representing the federal government. Each tribe was required by Cooley to end slavery, build dwellings for the freedmen, and cede a portion of their territory for the colonisation of other American Indians. The council adjourned due to the opposing viewpoints and attitudes and because certain tribe representatives lacked the power to ratify the conditions of the treaty, and discussions were not resumed until the spring and summer of 1866.

The other three tribes either had almost similar numbers of soldiers fighting on both sides or had more on the side of the Union, as was the case with the Cherokee, whilst the Choctaw and Chickasaw were unified in their support of the Confederacy. After the Civil War, the United States ignored the fact that certain tribal members had backed the Union when drafting the Reconstruction Treaties.

The Leased District in the western half of the Choctaw and Chickasaw's land was sold to the United States for $300,000 as part of their rebuilding pact. The whole land occupied by the Five Tribes was referred to in the reconstruction treaty's provision (dated July 1866) as the "territory of Oklahoma." Allen Wright, a member of the Choctaw delegation, proposed the name Oklahoma for the first time in a United States government document.
