There are many landmark cases which explore the rights and duties of a passenger involved in the Traffic Stop. In Pennsylvania v. Mimms, SC said that Police Officer can order a passenger out of vehicle during a traffic stop.

In the Maryland v. Wilson, SC ordered that a Police officer can restrict the passenger's movement to ensure officer's safety. In Arizona v. Johnson, the Court held that passenger is not free to leave the scene while a police officer is conducting a routine traffic stop.

Therefore, If someone is involved in a traffic stop as a passenger, he/she cannot leave even he/she is not detained. Thus the Statement is FALSE.
