The right to speech protected under the First Amendment, referred to as the incorporation doctrine grants the people the constitutional right to free speech, which applies to state and local governments against individuals and business enterprises. This law also prevents government restrictions on speech, however restrictions imposed by private individuals or businesses unless they act on behalf of the government is protected. This has to lead to persons, especially employees, to be restricted in  free speech regarding issues such as disclosing their salary to other employees or even soliciting for trade unions registration. In my opinion, this exemption to free speech should be amended to enable better transparency, especially in serious matters such as labor issues; hence the protection extended to a business should be given a second thought.
