The USSR was in the right as it has conducted trial and complied with every legal requirement,  before taking any action against the spy.

Background:

The USSR had spotted a an American pilot flying a spy plane,entering without permission in restricted air space .USSR shot the plane down without killing the pilot. Even the USSR had spies in the US, they caught the American spy nonetheless.

The official paper states,"After extensive questioning by the KGB, Powers was convicted of spying and sentenced to three years in prison and seven more of hard labor."

This proves that the trial was made and the spy plane really was a spy, so the Soviets did what they felt right and put the pilot behind the bars. Later on though, prisoner trade was made to settle the disputes.

Hence, USSR was correct on its part.
