Separation of powers is the idea that power in a government should be broken up or divided. This is shown in the US government with the 3 branches of government. The Legislative, Executive, and Judicial branches work together yet separately to run the government. This makes sure that no one person or group can control the government, and all branches have to agree. This ties into checks and balances, where each government branch makes sure the others are doing their job and being responsible.

The goal of the Separation of Powers is to prevent power concentration and to create checks and balances.

What is the separation of powers?

The separation of powers was a fundamental tenet of the United States' early founding fathers, who believed in establishing three distinct tiers of government,  in order to limit the authority of each and promote fair governance;

  • Executive
  • Legislative
  • Judicial

According to the author, this viewpoint was largely held by ardent Federalists. However, anti-federalists were opposed to three levels of government and argued that it would be difficult to rule when one division had more authority than the other.

For example, if the judiciary develops more powerfully than the executive department or vice versa, it can lead to not only governance difficulties but also insinuation and corruption.

Federalists, on the other hand, believed that these divisions would ensure that one part of government kept a check on the other.
