During an eight‐year legal battle, Mrs. James was awarded damages that ran as high as $575,000 but that were reduced on appeal to $55,787. Later, his seniority title was denied and he was expulsed from his political charge. On March 1, 1967, the House went beyond the Select Committee's exclude Mr. Powell from the 90th Congress because of the alleged misuse of public funds and charges.
Nevertheless, excluding him was unconstitutional, that was the reason why, years later, the Supreme Court established that with the expulsion they had violated the Constitution.
