In its decision on the confirmation of charges against germain katanga and mathieu ngudjolo chui,104 the international criminal court (icc) pre-trial chamber i addresses a substantial number of difficult legal issues, some of them for the first time. one of the most interesting passages of the decision deals with the question of perpetration through another person under article 25(3)(a) icc statute. . . . the accused germain katanga and mathieu ngudjolo chui were leaders of military groups

Respuesta :

The accused Mathieu Ngudjolo Chui and Germain Katanga were commanders of military groups associated with different ethnic groups in the Eastern Congo region of Ituri.

Chui and Katana started the common plan to ‘wipe out’ Bogoro village in February 2003. Each of their groups executed the plain in joint action. The troops annihilated many members of Bogoro’s civilian population during this event, and perpetrated atrocities that were war crimes and crimes against humanity.
