Officer Breskin saw Robert engaged in what appeared to be a drug transaction. Officer Breskin yelled at Robert to "stop" and that he was "under arrest," however upon seeing and hearing Officer Breskin, Robert immediately ran away. Officer Breskin chased Robert continually yelling after him to "stop" and that he was "under arrest." At this point Officer Breskin's encounter with Robert:
a) constitutes an arrest because Officer Breskin has clearly communicated to Robert that he is "under arrest."
b) constitutes an investigatory detention because Officer Breskin has yelled to Robert to "stop" and has not physically restrained him yet.
c) constitutes a seizure because a reasonable person in Robert's position would not have felt free to leave or otherwise terminate his encounter with Officer Breskin.
d) does not constitute a seizure within the meaning of the 4th Amendment because Robert has neither been physically restrained nor has he submitted to Officer Breskin's assertion of authority.
